Private Prosecution: Chief Justice Calls For Port Louis District Court File

The motion filed by Pravind Jugnauth in the Supreme Court was called this Friday, 29 October. The Prime Minister is asking the Supreme Court to quash the Private Prosecution filed by Suren Dayal against him in the Port Louis District Court. Suren Dayal accuses the Head of Government of having sworn a false affidavit in connection with his election expenses in the 7 November 2019 parliamentary elections.

This morning before the Chief Justice, Désiré Basset, Senior Counsel, and lawyer for the PM, and Antoine Domingue, Senior Counsel and lawyer for Suren Dayal, made a joint motion that the original file of the Private Prosecution, from the District Court, be transmitted to the Supreme Court. They asked it remains there until the Supreme Court rule on the PM’s motion.

Chief Justice Asraf Caunhye granted the motion. The PM’s motion in the Supreme Court will be heard on the merits on 11 November. It should be recalled that the Chief Justice ordered the freezing of the Private Prosecution in the District Court during the previous hearing.
