Compulsory Vaccination: A Petition Lodged Supreme Court

On Wednesday 9th June 2021, Joseph Lindsay Mario Marion, a 62-year-old man residing Quatre-Bornes, has filed a petition for judicial review at the Supreme Court. The plaintiff wants to challenge the Regulations being put in place by the government as from the 21st June 2021, whereby there will be no access to schools and hospitals for unvaccinated persons without the result of a PCR test of no more than 7 days.

As per his barrister, Lovena Sowkhee, several grounds have been considered before entering this petition. Restricting the access to the premises of hospitals and schools unless vaccinated is considered as being both anti-constitutional and anti-democratic. In addition, the petition requests for a “Stay of Execution”. In other words, the Regulations to be put on hold pending the Court’s decision, given that a Judicial Review may take time.

In the petition, Joseph Lindsay Mario Marion asks that the consent form for vaccination be declared as null and void.

Mr. Kaviraj Bokhoree, the attorney of Mr. Marion, has stated that there are several defendants cited in this petition, amongst which are the Minister of Health, the Minister of Education, the Prime Minister and Dr. Laurent Musango from World Health Organisation (WHO).

The case will be called this Monday, June 14, 2021 before the Chief Justice, Asraf Caunhye.
