Suren Dayal’s Private Prosecution Against Pravind Jugnauth Frozen

An order of stay of execution was emitted this morning by the Chief Justice. This decision was taken after Suren Dayal’s representatives stated they do not object to Pravind Jugnauth’s request.

After leaving court, Roshi Bhadain, one of Dayal’s lawyers, explained that the private prosecution was initiated in the Port Louis court, whereas it is the Supreme Court that is called upon to rule on the legality of this action.

After the case was called this morning, Pravind Jugnauth filed an affidavit in which he replied to Suren Dayal’s arguments, contained in an affidavit sworn yesterday. Suren Dayal’s lawyers then announced that Dayal would swear a new affidavit to reply to the Prime Minister.

Accordingly, the chief justice summoned all parties to Friday, 10 am. The court will take cognizance of Suren Dayal’s affidavit, after which the proceedings will start on the main issue.

It may be recalled that on Monday, 18 October 021, the defeated candidate in Constituency No 8 lodged a Private Prosecution against the Prime Minister. He is accusing him of swearing a false affidavit concerning his election expenses.

Pravind Jugnauth retaliated on the following Friday by making an application so that the Private Prosecution initiated against him by Suren Dayal be declared illegal and be dismissed.
