Election Commissioner Fails To Get Permission From Supreme Court To Resort To Privy Council

Senior Puisne Judge Nirmala Devat and Justice David Chan Kan Cheong rejected the Electoral Commissioner’s application for permission to have recourse to the King’s Privy Council.

Irfan Rahman and Esthelle Lambert-Henry, Returning Officer in constituency no. 15 at the last general election, had filed a motion calling for the rejection of Cader Syed Hossen’s election petition.

However, in a ruling handed down at the beginning of January, Justices Benjamin Marie Joseph and Ratna Seetohul-Toolsee dismissed the motion. They also ruled that Irfan Rahman and Esthelle Lambert-Henry had to provide Personal Answers.

Unhappy with the two judges’ decision, Irfan Rahman applied to the Supreme Court for permission to challenge it before the Privy Council. He was refused by Senior Puisne Judge Nirmala Devat and Justice David Chan Kan Cheong.

Irfan Rahman will therefore have to provide the famous Personal Answers.
