The constitutional case of Rezistans ek Alternativ is not a matter of public interest and there is no live issue, says the representative of the Attorney General.

The answer will be known this today. In July, the representative of the Attorney General’s office, Diya Beesoondoyal stated that the case was no longer relevant and could no longer be of public interest. Rex Stephen objected and gave his arguments. The position of the Attorney General, through his representative, had outraged Ashok Subron and the leaders of the Left movement. If the Supreme Court finds that the case is still of public interest, the real fight will begin in front of the full bench.

It is to be recalled that on 14 July 2022, the case initiated by the left-wing movement 17 years ago was called before the full bench of the Supreme Court this morning. At the preliminary session, Kumari Kamlesh-Domah, representing the State Law Office, made a remark about two judges sitting on the full bench. She said that Iqbal Maghooa and Gaitree Jugessur-Manna served as Returning Officers in the 2010 parliamentary elections. As a result, they had invalidated the candidacy of three members of Rezistans ek Alternativ. Kamlesh-Domah, however, said that he had no problem with this because they had only done their job as Returning Officers. After a discussion in the chambers, Judge Iqbal Maghooa stated that the full bench took into consideration the observation made. He pointed out that in 2010, the judges concerned had acted as Returning Officers but that now “they will go by the law.”
