Dawood Rawat attempts to overrule a former judgment has failed before the Tribunal de Premiere Instance de Bruxelles. Mr Rawat had initially-instituted proceedings of arbitration against Mauritius for the downfall of the former Bramer Bank followed by the collapsed and end of his company the British American Insurance (BAI) group.
The events happened in 2015 just one month after a new government had took place.
A court of Arbitration was set up to see both parties in litigation that is Rawat on one hand and the State of Mauritius on the other hand.
Mr Rawat claimed that he had a right to arbitration under the treaty of bilateral investment signed between Mauritius and France. Rawat has French citizenship as well as being a citizen of Mauritius.
The court of Arbitration held that the treaty concerns matters between individuals of both countries and that excluded those who had double citizenships. In addition, the court held that it could not entertain the arbitration process claimed by Mr Rawat.
The latter appealed before the Tribunal de Premiere Instance de Bruxelles, who conformed the previous judgment and set aside the claims of Mr Rawat.
