The MTC Sports and Leisure Ltd met the last deadline of April 7 to submit all the essential documentation and information to the Gambling Regulatory Authority (GRA) for its application for a horse racing organiser licence to be processed.
The missing parts were: The Audited Financial Statements for the period ending December 2021; a Certificate of Solvency from your Auditors; various Lease Agreements witnessing the transfer of undertaking between the Mauritius Turf Club (MTC) and the MTCSL so that the MTCSL will be again in a position to comply with its legal obligations relevant to the Horse Racing Organiser as set under section 31 of The GRA Act; and information on the MTCSL and its beneficial owners establishing to the satisfaction of the HRD that they must fulfil the criteria of fitness and propriety and other legal obligations pertaining on the Horse Racing Organiser.
The MTCSL have changed nearly all members its board of directors. Denis Doger de Speville and Anoop Madhow were fired, the two independent directors, Rima Ramsaran and Anjali Jhowry slammed the door. The were replaced by Hurshit Woomchurn, Vishwadass Kaniah and Shalini Roy Bunwaree-Nagdan who joined the other nominees, namely, Anil Kumar Ramnarain, Nicolas Carosin and Jérôme Pilot while Paul France Tennant, who is the only survivor of last week’s dismissals. Another decision was the appointment of Jérôme Pilot as acting CEO, following the resignation of Jérôme Tuckmansing. Only Paul France Tennat has got his Personal Management Licence.
That might be an issue as the GRA reminded clearly the MTCSL and its only shareholder, the MTC that in their legal capacity as a Public Company incorporated under the Companies Act 2001 and Registered Association under Registration of Association Act, that they are duty bound to comply with all the existing applicable laws and regulations at the time of their application and they must be fully compliant with the provisions under the GRA Act. And they must operate within the legal parameters and purview of the law.
The application of the MTCSL will now be processed and the GRA will have to take a decision quickly as the new racing season is due to start on April 23.
