The Case Of Pravind Jugnauth Vs Suren Dayal Has Been Postponed For Tomorrow

Last Monday, the defeated candidate in Constituency No 8 had lodged a Private Prosecution against the Prime Minister, accusing the latter of having sworn a false affidavit concerning his expenses for the elections.

Pravind Jugnauth retaliated on Friday by making an application so that the Private Prosecution initiated against him by Suren Dayal be declared illegal and thus, dismissed. The Prime Minister is also demanding that freezing order be issued until the Supreme Court rules on this first application.

However, the Chief Justice was absent this morning in Court. In fact, Asraf Caunhye was due to return to Mauritius from a trip abroad but it appears that his plane got delayed. So the case regarding the applications of Pravind Jugnauth for the Private Prosecution initiated against him by Suren Dayal has been adjourned to tomorrow, Tuesday 26th October at 10:45 am.

It should however be noted that today, Suren Dayal has countered with an affidavit whereby he is arguing that this is a gross abuse of process intended to prevent the DPP from exercising his powers under Section 72 of the Constitution. Suren Dayal deplores that the DPP has deliberately not been joined as third party in this case.

In his affidavit, Suren Dayal points out that the DPP, in a letter dated 21st October, asked his lawyer, Me. Antoine Domingue to send him all the elements in their possession so that his office could make a decision.

For Suren Dayal, Pravind Jugnauth’s application should be rejected.
