The accounting firm, its Managing Partner, Mohammad Ayoob Yacoob Ramtoola, and former Deputy Group Managing Partner, Afsar Ebrahim, have been granted leave to challenge the report of the Commission of Inquiry into the Britam case. The decision was announced on Monday 03 October 2022. The three lodged an application for judicial review before Justices Iqbal Maghooa and Carol Green-Jokhoo, and these applications were directed against the Chairman of the Commission of Inquiry, former judge, Bushan Domah and his two assessors, Sattar Hajee Abdoula and Imrith Ramtohul. The legal representative of the enquiry, Assistant Solicitor General, Pranay Sewpal, informed the judges that he has no objection. This stand follows the Supreme Court judgment dated August 31, 2022, to allow Roshi Bhadain to challenge the findings of the Britam Inquiry report. The report of the Commission of Inquiry was made public on 27 July 2021. It refers to the sale of 23% of the shares held by the former British American Investment (Mauritius) Co Ltd in Britam Holdings Ltd (Kenya). The report had recommended investigations for forgery, among other things, against a list of individuals.
