Judge Denis Mootoo has ordered SOS Guard Ltd to pay more than Rs 2 M to the National Housing Company Development (NHDC) for numerous thefts that occurred on the housing premises at Mahebourg,
In 2004, SOS Guard Ltd successfully won the tender for the provision security services on NHDC housing premises at Mahebourg.
Both parties agreed that SOS Guard Ltd would assume total responsibility for all thefts and damages caused to property at the said housing estates and would replace any damaged and stolen property. However, there were numerous thefts at the housing estates at Mahebourg on different occasions. At one time, electric wiring had been stolen; at other times, doors and other items. SOS Guard Ltd claimed that it was having difficulties in providing the agreed security services because of, inter alia, the lack of fencing and lighting at the housing estates which allegedly fell under the responsibility of the NHDC. But the Supreme Court had held that it was the responsibility pf the security company to make sure that things are not stolen and therefore orders it to pay damages of some Rs 2 M.
