Judicial Enquiry On The Death Of Jockey Juglall: The Acting Director Of SAMU Will Testify

Must Read

Wednesday, in the district court of Port-Louis, Mr Yahia Nazroo, legal representative of the Mauritius Turf Club objected to Dr. Ancharaz, Acting Director of SAMU, being called to testify during the judicial inquiry aimed at shedding light on the fatal fall of jockey Nooresh Juglall last May 15 at the Champ de Mars.

The barrister argued that only people with direct connection and knowledge of the case should be called to testify.

However, Mr. Nataraj Muneesamy, the representative of the Director of Public Prosecutions, held a different view. He argued that Mr. Nazroo was only a “watching brief” in the judicial investigation and, as such, he could not object to the hearing of a witness. He added that an expert opinion can help determine whether there was negligence.

In her ruling, Magistrate Shavina Jugnauth said that a “watching brief” is not allowed to make such a motion in the context of a judicial inquiry.

Dr. Ancharaz will be able to explain the medical procedure in an emergency to help the court determine if there was negligence or worse. Dr. Ancharaz will testify on December 3.

However, proceedings will resume on November 23 with the much-anticipated testimony of Dr. Nunraj Dhawal.
