Justices Benjamin Marie-Joseph and Ratna Seetohul-Toolsee announced their decision on Wednesday. The case is that of the Electoral Petition of Cader Sayed Hossen in Constituency 15. Irfan Rahman, the Electoral Commissioner, and Esthelle Lambert-Henry, the Returning Officer of constituency number 15 in the 2019 general election, had moved for the dismissal of the election petition of defeated candidate Cader Syed Hossen. However, in an interlocutory judgment, the two judges rejected the motion. They also asked Irfan Rahman and Esthelle Lambert-Henry to provide Personal Answers on 2 and 3 February. In his election petition, Cader Sayed Hossen asked for a recount of the votes he and Gilbert Bablee received. Only 49 votes separate them.
The case is scheduled in the Supreme Court on February 2 and 3 with a probability of recount as was the case in No. 19
