The case was called before Senior Puisne Judge Nirmala Devat and Justice Patrick Kam Sing on Wednesday. The session was devoted to the pleadings of the lawyers of the parties concerned.
It will be recalled that on September 30, 2022, the full Supreme Court rejected Rezistans ek Alternative’s application to challenge the constitutionality of the requirement for candidates to declare their ethnicity in order to participate in the general elections on a technicality.
The leaders of the left-wing movement want to appeal to the Privy Council to challenge the decision of the plenary assembly. Their representative, Mr. Yashley Reesaul, insisted in his plea that the rejection of these candidacies was a violation of the Constitution.
Priya Ramjeeawon-Varma, representing the State, argued that the “starting point” of the case was misrepresented. The violation of rights should have been demonstrated, she said. According to her, the judgment of the plenary assembly had been misread and misunderstood.
