The case relates to a judgement handed down on 16 November last by the Supreme Court. The judges had ruled in Franklin’s favour, overturning a decision by the Port-Louis court that had denied the suspect bail. The Supreme Court had ordered that Franklin’s parole motion be re-examined by the Port-Louis court.
However, last Friday in court in Port-Louis, Mr Yvan Jean-Louis, who represents the Attorney General’s Office, informed the magistrate of Port-Louis that he had obtained a freeze on the judgement from Chief Justice Rehana Mungly-Gulbul because he intended to appeal to the Privy Council.
An application for leave to apply to the Privy Council will be made to the Supreme Court.
As a result, the motion for release that was due to be debated on Monday has been postponed to 18 December.
