A victory for the Leader of the Reform Party. Justices Gaitree Jugessur-Manna and Patrick Kam Sing have granted his application for leave to proceed with his judicial review of the findings of the Britam Commission. The action is against former Judge, Bushan Domah and his two assessors, Satar Hajee Abdoula and Imrit Ramtohul, having the Attorney General and Yacoob Ramtoola as co-defendants.
Both judges were of the view that in the present case, the applicant, Roshi Bhadain, is challenging the integrity of two of the three members of the Britam Commission, namely the Chairman, Bushan Domah, and Satar Hajee Abdoula. In doing so, he is questioning one of the basic principles of a Commission of Enquiry, namely impartiality. For this reason, the judges granted permission to Roshi Bhadain to proceed with the judicial review.
