The case was called before Chief Justice Rehana Mungly-Gulbul yeterday morning. It has been adjourned to 9 October to allow Ameenah Gurib-Fakim time to complete her affidavit. The former President of the Republic wants to challenge the conclusions of the commission of enquiry chaired by former Chief Justice Asraf Caunhye.
Her application for Judicial Review was rejected by the Supreme Court. She wants to challenge this rejection before the Privy Council. Ameenah Gurib-Fakim is therefore seeking permission from the Supreme Court to appeal to the King’s Privy Council.
At the begging of September, the legal representatives of the various co-defendants, including former Chief Justice Asraf Caunhye, Nirmala Devat, Senior Puisne Judge, and Justice Gaitree Jugessur-Manna, have indicated in court that they are aware of Ameenah Gurib-Fakim’s affidavit, and intend to respond to it.
