Twitter Loses Immunity Over User-Generated Content In India

The Indian government declared that Twitter had lost its liability protection against user-generated content since the US microblogging giant did not comply to the new IT rules put forward.

The Prime Minister Narendra Modi’s administration has criticised the company several times for non-compliance to the new IT rules in a court filing. Due to this the platform has list its immunity. This raises concern since American firms might find it more difficult to conduct business amid a more rigid regulatory environment.

The case was put to effect when a Twitter user filed a case against the platform to complain about some derogatory tweets and said that the company was not complying with the new which stated the appointment of new executives. While the company stated that it was doing its best to comply to the new rules, it refused to give any comment about the case.

As the new rules became enforced near the end of May, technology minister, Ravi Shankar Prasad, accused Twitter of deliberately disobeying the new regulations since all other social media platforms have already complied. As tension rises between the company and New Delhi, police have already recorded five cases against the company or its executives, including some related to child pornography and a controversial map of India on its career page. Twitter India chief, Manish Maheshwari, has been named by police in two states. However, the state of Uttar has challenged in the Supreme Court a bar on police action against Maneshwari, after a lower court protected him against arrest over an accusation that the platform was used to spread hate.
