Senior Counsel, Desire Basset will be the leading counsel in the Private Prosecution case of Suren Dayal against Pravind Jugnauth.
Mr. Dayal’s counsel, Antoine Domaingue was challenging the presence of Basset SC, whom he believed should not be the leading counsel of the PM on the basis of conflict of interest.
The Supreme Court has rejected this motion stating that such motion, unsupported by any solid legal foundation, should be strongly and strenuously discouraged as it may open the floodgates to baseless attempts at challenging the appearance of counsel and thereby, disrupting the timely and orderly dispatch of cases and seriously jeopardizing the effective administration of justice.
‘The present motion is indeed a gross abuse of the process of the court’, says the Full Bench of the Supreme Court.
The Private Prosecution against the Prime Minister has been initiated by one of his defeated opponents, Suren Dayal on matter of the electoral expenses in the general polls of 2019.
